Terms of Service

These Terms of Service ("Terms") govern your use of “What the Heck is That? A Quiz Game” ("the Game"), a mobile puzzle game developed by “monoinyo studio”. By downloading, installing, or using the Game, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the Game.

 

License

1. “monoinyo studio” grants you a limited, non-exclusive, non-transferable, revocable license to use the Game for personal, non-commercial purposes on a mobile device owned or controlled by you.

2. You may not modify, distribute, reproduce, or create derivative works based on the Game. Any unauthorized use of the Game may violate copyright laws and other applicable regulations.

 

Intellectual Property

1. All intellectual property rights, including but not limited to copyrights, trademarks, and trade secrets, in and to the Game are owned by “monoinyo studio” and its licensors.

2. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in or on the Game.

 

In-Game Purchases

1. The Game may offer in-app purchases or virtual goods for real or virtual currencies. Any such transactions are solely between you and the respective third-party platform (e.g., Google Play Store). 

2. “monoinyo studio” is not responsible for any issues arising from such transactions, including but not limited to billing, refunds, or disputes.

 

User Conduct

1. You agree to use the Game only for lawful purposes and in accordance with these Terms and any applicable laws and regulations.

2. You shall not engage in any activity that may disrupt or interfere with the operation of the Game or compromise its security.

 

Privacy

a. “monoinyo studio” respects your privacy and handles personal information in accordance with its Privacy Policy.

b. By using the Game, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

 

Limitation of Liability

1. “monoinyo studio” shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or relating to the use or inability to use the Game, even if advised of the possibility of such damages.

2. “monoinyo studio” does not warrant the accuracy, reliability, or availability of the Game and disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

3. “monoinyo studio” shall not be liable for any unintended likenesses, resemblances, or similarities between in-game characters, objects, or content and real individuals, entities, or copyrighted materials. The Game may include randomly generated or user-generated content, and any resemblance to real individuals, entities, or copyrighted materials is purely coincidental.

 

Indemnification

You agree to indemnify, defend, and hold harmless “monoinyo studio”, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses arising out of or in connection with your use of the Game or any violation of these Terms.

 

Changes to the Terms

1. “monoinyo studio” reserves the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting the revised Terms within the Game.

2. Continued use of the Game after any such changes constitutes your acceptance of the modified Terms.

 

Severability

1. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

 

Termination

1. “monoinyo studio” may, at its sole discretion, terminate your access to the Game at any time without notice or liability.

2. Upon termination, the provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property rights, limitation of liability, and dispute resolution.

 

Governing Law and Jurisdiction

1. These Terms shall be governed by and construed in accordance with the laws of the United States of America.

2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in the United States of America.
